Austin Man DUI
An Austin man will be charged with DUI after being pulled over last Sunday morning at 1:50 AM in the area of Summit Street in Austin Boro by State Police.
Herbert A. Watson, 36, Foster Street, Austin, PA, was pulled over for a traffic violation and found to be intoxicated.
He will answer charges in District Court 55-3-01.

He was pulled over because Lucas Toomey called the police on him for turning around in his parking lot. He passed 4 Breathalyzer tests and a field sobriety test and was only charged with the DUI cause he refused the BAC. They made him do all these tests cause he smelled like beer. He smelled like beer cause we both took our cars to the Forrest House that night to drive people home who wanted to go out drinking. You can ask anyone who was with us that night - Herb was not drunk. The only reason he is in trouble is cause he smelled like beer while giving people rides home from the bar. So before anyone runs their mouths, maybe you should find out the whole story. I can't tell you how many times I have had to say that on here!! By the way, the only reason he refused the BAC was because he was agitated that the police were arresting him after he passed 4 breathalyzers and a field sobriety test, while the officers there even said his speech was fine, he was alert and he didn't appear to be intoxicated. So this was more of a matter of a police fishing expedition than anything else. Any questions about this incident, I will be more than happy to answer so that you people who post comments without the whole story can stop looking stupid.

If you refuse the bac then the dui is automatic thats the law .Pretty stupid to refuse if your not guilty! DUH !

Commenter @7:04 should not post mis-information like this. It is not automatic DUI if you refuse! It is an automatic suspension of your license for 1 year. Its called Implied Consent. You may also get convicted of a DUI (by trial or plea) but it is by no means "automatic". It looks as if this man complied with the tests. How many does the state want before they determine impairment? If the facts of this case indicate that he passed the field sobriety initially then it is winable from the DUI standpoint. 1 year license suspension will be automatic regardless if he is convicted of DUI or not.
