Zero. The number of actual rulings which have been handed down in the alleged “baby buying case” against local attorney Jarett Smith, members of his family, his ex-wife, and the mother of one of the babies put up for adoption.
Zero. The number of preliminary hearings which have been held. None of the charges lodged against any of the defendants have been bound over to court.
Pennsylvania law mandates a preliminary hearing “shall” be scheduled not less than three nor more than 10 days after arraignment. It will be two years in May since criminal charges were filed.
Zero. The number of decisions on individual issues which were raised by the PA Attorney General’s Office and several defense attorneys and are still pending before the court-appointed judge.

How is it that this twit is still practicing law? I can understand how he wouldn't be disbarred as he hasn't been convicted (yet) but, at the very least shouldn't his privilige to practice be suspended????
I don't know why this is, but I would bet the Pa Attorney General would be able to find out why.
Why isn't the DA involved in this and flexing his "rubber stamp"?
It is amazing how the one can get out of a crime because of a timeline but he is aloowed to stretch other peoples cases out forever to collect money.
I read this twice. What is the news? All a rehash of stuff.
Obviously, That is the news!
Kinda like Corbett and Sandusky.
This dude sick!!!
Come on Andy Use your Rubber Stamp.
Oh you only do that when you know peole who cant afford a good lawers. That way you can get them to plea out. Andy the locals have your Number. Stamp away and keep supporting your dishonest cops it will catch up with you!!!!!!
Ugotta & 7:41: What pare of this is being handled by the Attorney General's Office wasn't perfectly clear??? The local District Attorney CANNOT handle this because it would be a conflict of interest. It really would be nice if you had the first clue what you're talking about before you start spewing out meaningless crap.
Hollywood stars buy babys all the time! Isn't it the same thing?
I agree no news here!!! Statute of limitations on the state police not filing formal charges! If they had a case they would have done something not just big talk like usual with PSP!!!
Psp did file the charges. Read the article...it's the prelim they are still waiting to have...
Charges were filed two years ago.
The charges were filed 2 years ago but the investigation started 4 years ago. FTA:
"It will be four years in June, since the alleged criminal acts occurred and were turned over to State Police for investigation. State Police waited until the two year statute of limitations had almost run out before filing the criminal charges in May 2011."
They are clearly in no hurry.
The statute of limitations is in regards to when the crime took place. The investigation obviously took quite some time. That being said, the delay now is not due to law enforcement.
The article clearly talks about the delays with the Court system. This has nothing to do with when charges were filed.
There is an investigation that happens. Sometimes that can take years. I'd rather all their ducks be in a row for charges such as theses then to proceed with blind eyes!
The delay is not a result of Law Enforcement, it's from the Court's.
The article is showing that nothing has happened since the charges have been filed. Not that Law Enforcement is causing this delay.
The length of the investigation, the statute of limitations, or how long it took to file charges, have absolutely nothing to do with the failure to proceed with required Court hearings.
