UPDATED: Court records obtained in the case reveal the details of the allegations.
In an Affidavitt of Probable Cause, TFC Glenn C. Drake II wrote:
"The victim in this case is a white non-Hispanic female, who is currently 15 years old, that will be referred to as xxxx from here forward."
"On 5/16/13, I was contacted to meet with the Defendant's son at the Oswayo Valley High School. The defendant's son had located a suicide note in his father's dresser drawer and was concerned for his father's safety. I met with the Defendant's son who provided me with this note. I read it and it indicated that the defendant was in love with xxxx, and had an inappropriate relationship with her. In this letter, he gave specific details of events and touching that constituted Indecent Assault. In this letter he also spoke of buying a vibrator for xxxx."
"On 5/16/13 at approximately 1215 hours, I met with xxxx. She related that the Defendant did touch her inappropriately on several occasions. He touched her on her vaginal area over her pants. He told her that this was not an accident. He also on several occasions in the pool would grab her from behind and press his groin against her buttocks. She stated this happened several times and for approximately 5 or 10 minutes at a time. The Victim indicated that Defendant professed his love to her and even wrote her inappropriate sexually explicit love letters."
"On 5/16/13 at approximately 1515 hours, the Defendant was brought to PSP Coudersport and advised of his Miranda Warnings. He agreed to speak about this case without an attorney present. He expressed remorse and embarrassment. He indicated that his feeling and behavior with xxxx was inappropriate. He indicated that he believes he was sexually grooming her with his actions. He acknowledged inappropriate touch and stated that he did touch the Victim on her vaginal area over top of her clothes on one occasion. He also acknowledged the Victim's buttocks touching his groin area and this sexually exciting him. The Defendant indicated that the inappropriate touching with the Victim sexually excited him and he used that excitement to later masturbate."
McMullen is scheduled for a Preliminary Hearing before District Judge Kari A. Stubbs on May 29, 2013 at 10:00 AM.
