Road Worker Lifeflighted / Emporium Driver Jailed

An Emporium man was jailed on felony aggravated assault charges and a Gaines Township (Tioga County) road worker was lifeflighted to a trauma center after an altercation at a roadwork site late Wednesday morning.

Vincent A. Earle, 25, of Emporium, PA, was charged by State Police at Mansfield with:

Earle was later identified, located, arrested and arraigned before District Judge Robert L. Repard at 9:28 PM and remanded to the Tioga County Prison in lieu of $25,000.cash bail.

Randall Ferguson, 55, of Gaines, PA, a Gaines Township road worker, was transported by Galeton Ambulance to a landing zone where a helicopter transported him to Robert Packer Hospital in Sayre for treatment of a broken nose, broken leg and lacerations to his arm.

According to a published report in the Wellsboro Gazette, State Police said Earle reportedly drove his 2004 Dodge Ram truck north through the work zone at a high rate of speed, nearly striking a road grader. Ferguson stopped Earle at the intersection and attempted to get his license information. Earle attempted to drive away, at which time Ferguson reportedly punched Earle and grabbed onto the truck. Earle then allegedly knocked Ferguson off the truck and struck/dragged him with the vehicle. Earle then reportedly fled south on Elk Run Road.

Why would a road worker even punch someone when all he had to do was get his licence number. Not to take away from the crime, but that was a bit of a bad choice.

I see no crime here on his part only the road workers he had no right taking it that far and any attorney would say the same in court he fled for fear of safety on his well being

how many of you have ever stood in the road with a sign and almost been hit by a vehicle i'll bet any money that your thoughts would be different on the whole situation at that point to bad Ferguson didnt't carry a better weapon than a fist cause then the poor guy wouldn't have been hurt

This is for post 12:18 PM. What do you mean NO CRIME ???? Randy had to be life flighted due to his injuries!!!!! As far as the driver goes, I believe your comment was he fled for the safety of his well being. If that being the case WHY didn't the driver call the police after he got to a safe location???WHY did the police have to do a intense search for this vehicle? Then from what I was told they located the driver at his work, hours later!!!! I have one more question / comment to post 12:18. Have you ever worked on a road crew before? Well I have and people drive like IDIOTS!! They disregard the signs that are posted warning them of road crews ahead...It is pretty scary watching a vehicle speeding at you while your waving that red flag or stop paddles at them!! I cant speak for Randy but I can almost guarantee that all the road crew workers are fed up with people driving like idiots!!!Also Post 12:18 I am anxiously awaiting your reply to my questions / comments.

The road worker threw the first punch and then grabbed onto...and held onto a moving vehicle....so...earle was in the wrong for speeding in a work zone...but...the road worker made poor choices also...

To 1:09...the road worker was life flighted because he made the choice to grab onto a moving vehicle and suffered injuries because it was a bad decision just like speeding in a work zone....

I blame law enforcement for not protecting the workers. Other states like Massachusetts has a officer there to protect the workers. Other states also do. Government start taxing the gas companies we would have extra income for the state. And the comment about head lights in construction zones they don't enforce it. I drive about 2000 miles a week in pa and the police don't enforce the law! Cops are to busy going 80 plus just to waste tax paying money! Sate issue vehicles to.

ummm...it is a crime to speed through road work... the road worker was probably defending himself and his co workers who on a daily basis put themselves at risk from distracted and careless drivers! prayers go out to him and his family! Hope his recovery is quick! Please lets all slow down and be more careful. To many tragedies lately.

I agree that people need to be more cautious in work zones and that this driver was being an idiot.. but that still doesn't give this man the right to punch someone? Am I saying he deserved to be drug along the road? Absolutely not. But he certainly went about this the wrong way.. posing danger to himself and possibly other drivers or workers on his crew..

one has to question if the driver was going that fast. how was it the road worker was able to stop him? why did he think he could take the law in his own hands? why didn't he let go of the truck? I have to agree with no crime.i get punched and then drive away and you grab my truck and get hurt sorry about your luck.next time take down the plate number, call the police and, don't let your anger get the best of you.

8;05 you are right attempted murder and a sentence of at least 10 years of standing on the hot road or the freezing cold with a sign or flag to protect his fellow workers. To bad the grader operator didn't put the grader across the road and let him hit that. In Eldred a few years back a worker was killed and others injured because of a high or drunk driver. Was this guy???? I think the State should give the flagmen or women a billy club and if they don't stop start swinging. Flaging is a thankless job but does save lives. This guy that didn't stop is a bloomin IDIOT.

Earle deserves everything coming to him. Regardless of the last part of his trip through this work zone, HE WAS IN VIOLATION BY SPEEDING THOUGH THIS WORKZONE TO BEGIN WITH!!! A wrong at the end doesn't give him a free ride!

Kudos and dildines for the people who risk their lives in the highway construction zones. I am not going to past judgement on who was wrong or right or how the cops done their job but wanted to give the highway workers the old pat on the glutious maximux.

I have worked holding a flag in traffic & yes some people are assholes without a doubt! BUT,,,, I also know how pissed off I used to get at drivers,,, and I would have Loved to punch some of them in the face,, but I didn't. This road worker punched a guy in the face & then held onto his vehicle while it was still moving !!,,,,, I'm guessing he was planning to continue the fight,,, what the hell?? A flag person does NOT have the right to do that, no matter how mad he was because drivers are assholes,,,,, him getting injured was because of his own anger management issues. I have to question how fast this driver could have been going, considering the driver apparently stopped long enough to get attacted. And the police had to do this huge search for the driver,,,,,, Really?? Sounds to me like he just went to work, where he was going before being punched in he face.

If you actaully read this article is states....

This says that Ferguson was knocked off the truck. Ferguson was dragged because the driver hit him with the truck and drug him not becuase he was still holding on to it.

How was it determined he was speeding if no cop was there with radar? Was the construction worker trained to assess speed through observation? Wonder if the castle doctrine would have covered the driver if he would have been carrying??
