well now , if he was parked how in the h can he be arrested for dui ? may be he had a few and it hit him so he pulled over instead of driving on and killing himself or others . maybe some leaway should be given to someone who used their head besides isn't dui (driving) ?

Sorry knucklehead, reread the law. So typical, try to get someone off on a technicality. I'm sure this isn't the first time he has been driving and it "hit him". In this day and age, I think even knuckleheads would know that. Just glad he didn't hit an innocent person when the alcohol just "hit him". Good job PSP! 1 down, 1,111,110 to go. Unfortunately, the costs to society because of alcohol are 7x what the revenue from alcohol sales brings in! Think what that money would do to better society instead of using it to correct the ways of someone who never grew up. Keep selling alcohol though, so a bunch of ?? can sit at the gin mill and talk about how great donny is going to be.

3:33 if he was parked on the side of the road and legally drunk, obviously he drove to that spot. When the key is in the ignition you are "operating the vehicle" even if the engine is off. I knew of someone who did just what you assume this guy tried to do and decided to sleep it off, only to get a dui because he put the key in his ignition to roll down the power window when police stopped to check his welfare. Maybe he should have used his head and realized that if he had X amount of drinks or more, he should plan ahead for a sober ride home.
