In Pennsylvania the oil & gas owner has a reasonable priority when there's a proposed surface use conflict. In this case, Big Level has 26 turbine sites and JKLM only needs three locations that overlap with what Big Level wants. Big Level hasn't agreed to give up even one of these sites, however, despite JKLM's stronger legal position. That's why we are seeing litigation. If Big Level would compromise, the case would be over quickly. But they have said that they won't move anything - not a single turbine, road or power line, not even a little. I've seen the paperwork - JKLM had no option but to go to court when negotiations failed so completely.

JKLM is trying to follow the law and is required to submit plans for permit approval. Jack Young is correct. There is a reasonable priority, and they have been trying to be reasonable. If they cant drill at those planned locations everyone loses. No impact fees, no royalties. Sunsurface rights are protected by PA law.

Congratulations to Hector Township for allowing a wind factory once again in an area not deemed suitable for wind power because the sustained winds are inconsistent. This goes back to the old wind farm proposal from about 10 years ago that was finally dropped. Wind energy is a good thing if it is done properly but it sounds like Hector townships' greed has overcome any semblance of good sense. I am glad that JKLM has stepped in legally to remind Hector township that they simply can't just do anything they want without consequence.
