Seneca Custody Battle--Mom Has Marissa

WESB News: 05/03/08 - Custody Battle Continues

A former McKean County woman is fighting the Seneca Nation of Indians for custody of her 4-year-old daughter.

Kevin McGonnell is a member of the Seneca Nation and, because of treaties signed decades ago, US custody laws are not valid in the Seneca Nation. Amanda Prechtel, who now lives in Elk County, is fighting for her daughter Marissa anyway.

During a visit to her mother last week, Marissa said she didn't want to go back to Salamanca with her father. Seneca marshals traveled to St. Marys to serve a custody order from Seneca Peacemaker's Court.

But Amanda said she didn't answer the door, still has Marissa, and plans to keep fighting for her.

This issue has torn apart a family, and is going to profoundly impact the life of a formerly happy, exuberant young child. The entire extended family has gone nearly bankrupt attempting to procure competent legal representation, only to have numerous lawyers "quit" after they realize the complexity of dealing with the case - no refunds for incompetence of course. How many others will have to suffer the same? As an edcucator, I wonder how many others I will have to attempt to educate while experiencing far more profound difficuties and obstacles. Lawyers originated with "pro-bono." Where is that obligation today? Is it any different than a doctor who refuses to honor the hypocritical oath when faced with a patient who will die without their assistance?

Marissa is dying.

She will become another person -- affected by these circumstances. What type of person will she become??

Then I guess she shouldn't deny the Father the right to his daughter...its the mothers fault for not adhering to tje courts decision...i feel no sympathy for Amanda!!!
