WILLIAMSPORT - Additional tax evasion charges have been filed against the founder and former chief executive officer of Adelphia Communications Corp. and one of his sons.

A U.S. Middle District grand jury returned a superseding indictment Thursday against John J. Rigas, 83, and his son Timothy, 52, charging each with tax evasion for an additional year, 2001.

The indictment was returned the same day Judge John E. Jones III suspended activity in the case because of an appeal the two filed with the U.S. 3rd Circuit Court of Appeals.

They are challenging Jones' dismissal of their claim that their prosecution in Pennsylvania amounted to double jeopardy because they were convicted in a tax case in New York City and acquitted of a wire fraud count.

The new indictment alleges John and Timothy Rigas caused a tax loss to the government of $483 million in 1998 through 2001.

John Rigas is accused of evading $85 million in taxes for that period and Timothy Rigas $27 million. They are accused of causing a tax loss of $127 million for Michael Rigas, $119 million for James Rigas and $25 million for Ellen Rigas. More......
