Bottle Smelled Like Marijuana, Woman Charged

ELKLAND April D. Hand, 36, Osceola, was charged by Elkland Borough Police with possession of a small amount of marijuana for personal use and misbranding of a prescription bottle in Elkland District Court.

According to court documents, on April 15, Hand gave a prescription bottle labeled Citalopran for a refill to a receptionist at Laurel Health Center in Elkland. The bottle smelled like marijuana, the receptionist said, and laboratory research later determined that it had contained marijuana, according to police.

Hand waived a hearing before District Judge Brian Edgcomb, with an arraignment set before Judge Robert E. Dalton in Tioga County Court on Aug. 18.

Maybe the receptionist should be charged for knowing what marijuna smalls like!!

Wow, so since the bottle "smelled" like marijuana they were legally able to send it to a lab to have it tested? She owns the bottle and the pharmacy is a private business not a formal legal police agency so who's to say that the receptionist didn't have a grudge against the person dropping off the bottle and taint it? It just seems really weak to me....
