FOUND INNOCENT OF DISORDERLY CONDUCT FOR DIRT ON ROAD
An Austin man, charged by state police in late September with disorderly conduct was found innocent of the charge following a summary hearing before District Judge Annette Easton recently.

State police had cited Kenneth Clark,47 of Bearwalk Road, for allegedly moving a large pile of dirt and rock from the roadside onto the highway last on September 17, 2009.

Authorities claimed the alleged action created a hazardous condition for motorists but Judge Easton ruled in favor Clark. More news....

Glad to hear he was not guilty. It is not much different than Penn DOT spreading mud on the roads all winter for traction material.

Glad to hear common sense prevailed. But, then again, Judge Easton is KNOWN for having the common sense so severly lacking in many other people!! Glad to hear this Kenny!

I see PSP thought they had arrested PUBLIC ENEMY #2. And you wonder why they can not solve any crimes. They can't get off the main roads. NO BARS TO WATCH OFF THE MAIN ROAD.

Glad to hear this was handled the way it was (Kudos to Justice Easton who seems to have her head on straight as her father did as the Distict Justice for so many years!). Too many of the roads in Keating Township have been incorrectly graded for too many years - not to mention how the township went from having a monetary surplus and tools in inventory to being broke and NO darn tools! Let's remember it is voting season - get the dirt back on the road where it belongs and not in the township office! I'm voting for Mike Tumas and Charles Smith!

Glad to hear the outcome on this one,but have to wonder what is cost this poor guy out of his own pocket to fund his defense over something so ridiculous. I'm sure we have potholes that are deeper than the pile of dirt was on the road!

10/27-10;06 Poster?? I have been on both sides of the fence up there and didn't always like the verdicts,but always thought Annette was about as fair as you could get up there! Judge Leete was always fair too!! And BTW, I smoke Marlboro's!! :) Brad Jones

Im Glad to see that most of you feel that there is nothing wrong with piling 15-20 TON of dirt and gravel in a road it just shows the mentality and immaturity of the anonymous folks that enjoy posting comments on situations they have no clue about. But, I cannot help but wonder how you would feel if you were traveling on such roadway and rounded the corner and hit the LARGE pile of dirt that took up more then half of the road or better yet hit another motorist traveling the opposite direction because the large obstruction wouldn't fit two vehicles through at the same time. I just can't help but wonder how you would feel if you or one of your family or friends were seriously injured or killed because a distraught landowner decided to pile a large pile of dirt in the road. God forbid something like that would have happened. I guess its just another example of what happens when immaturity meets stupidity or what was the word you anonymous folks use "inanity". And as far as getting "the dirt back on the roads where it belongs" and going from a "monetary surplus and being broke" I'm sure the township officials would greatly appreciate and be more then happy to welcome any of you who would like to volunteer and help with the filling of potholes and patching of asphalt free of charge I think that would be one way to rectify the monetary issue that the township has as far as being "Broke".

Now Kenny don't you think these nice people should know that you got off on a technicality and that the officer with the PSP chose the wrong charge for the crime and that Judge Easton didn't want to dismiss the charge but because of how the law was interpreted by her she had to due to the fact she didn't feel the charge fit the crime? Man up Kenny tell em' how it really went down.

4:55 Township people get paid and from what i have seen some of the local townships have turned into (write yourself a paycheck)jobs.With no one to over see this they are broke.Volunteer? ya right!!!

The current township team needs to work a lot smarter (and harder) and put in a lot few hours - we are broke because there are too many people making a living off of the township...let's change that tomorrow and put some folks in there who will put the brakes on Moat's spending (and housing all the township equipment at his house!)

1:20> You expect to get better roads and safer winter driving conditions by having the township team put in fewer hours? That makes no sense. I'm very anxious to see how terrible and unsafe the roads will be this winter with our new township supervisors i hope they know what they are doing and what they got themselves into its easy to say how your going to do things and how your going to make things so much better but to actually do the job is another thing... good luck all winter travelers coming through Keating township...
