State Law Adds To ARD Fee For DA Reimbursements

dalogoGov. Ed Rendell has signed legislation that should clear the way for counties across the state to eventually receive the long overdue state reimbursement for a portion of their district attorney salaries.

House Bill 1607, signed on Friday, adds a $2.25 fee for those people who are admitted to Accelerated Rehabilitative Disposition (ARD) in criminal cases.

The money will go directly to the fund established to cover the Commonwealth share of the full-time district attorney salary. HB 1607 will expire after 25 months, after which General Fund appropriations may be necessary to cover future shortfalls.

State reimbursement of 65 percent of the full-time district attorney’s salary is required under Act 57 of 2005. The state’s failure to provide reimbursement has cost Potter County upwards of $200,000 over the past two years.

A dedicated Criminal Justice Enhancement Account was created in 2007 to meet this obligation. However, the fines and fees deposited into this account have been inadequate to meet the full state obligation.

Potter County paid the entire DA salary in 2008 and so far has paid the entire salary of $160,850 this year. Potter County Today

Well this only let's me to believe that more people will be getting ARD. he fee's should be across the board. Also what about fee's to go towards the support of local law enforcement. They always seem to be the one's that get the shaft. The county gets the money for what they do. Some money's need to befltered back to the local communities to support thier work.

Sure hope this hits the local press this week, so voters will realize how deceitful Andy J Watson was about his potential salary matters! I will be writing in Dawn Fink as I could not support someone who is so deceitful for District Attorney.

The Criminal Justice Enhancement Account....What is the dollar amount that is what they call a short fall.

At $2.25 person they would have to arrest over 7100 people a year.

Where have you people been who say there is nothing showing that Andy was deceitful????? It was in the local paper BEFORE the primary and then Solomon's Words re-ran the information that contained ANDY'S QUOTES!!!! HE SAID HE WOULD SAVE THE COUNTY $100,000 A YEAR AND THAT WAS B.S.--PURE AND SIMPLE!

People grow up, you all only see what you want to see. If Dawn is so all mighty and great then why is there a pharmicist with 238 felonies and stole from the welfare system still out on bail when if it was anyone else they would already be in the state prison system. Dawn can't do the job so let someone in that will do a better job than she did and build a bridge and get over it.

8:26 WHAT?? Dawn Fink tried that case in a Court of Law and won! A Jury of 12 people found the girl guilty of EVERY SINGLE COUNT!

It doesn't get any better than that!

Dawn Fink didn't sentence her, the JUDGE did!

as for the defendant out of bail, that's part of our judicial system! She has the right to an appeal and if she can come up with bail so be it!

Know what you are talking about before you get run over by the bus!

DAWN FINK won the biggest felony verdict EVER in Potter County after a TWO DAY jury trial! You can't throw sticks at that! Judge Leete is the one who does the sentencing, not the DA!!!!!!!!!!!!!!!

Get with the program 8:26. If you don't know how it works then just shut up about it. Dawn's job was to prove without a reasonable doubt that the defendant in that matter was guilty of those crimes. 12 people agreed and convicted her of 238 felony's. Sentencind/Appeal/Bail, her hands are tied!

Everyone wake up, Dawn had one good conviction out of how many. Give the new guy a chance before you pass judgement, the voters made there decision and so be it, if Andy doesn't do the job then there will be another election.

It ain't over yet! WRITE IN DAWN FINK FOR DA! Dawn has won PLENTY of cases, esp the sex offenders which are the ones most people care the most about! She's done a great job but has gotton a bad rap from a couple of cops because they don't like a woman running the show. Who wants someone as DA who tried to HOODWINK the voters about saving the county $100,000 a year anyway????

I often read about MANY convictions obtained by the DA's office--not just the pharmacy case! The public was foolish to buy Andy's promise of saving the county all that money. I'm writing in DAWN FINK for DA in November!

She don't care...Hell she don't even help her own army of police officers. She spent all the drug forfiture money on the so called detective. Nothing got done. Local law enforcement need to get out there and do some drug work and make areest. No support. No support for DUI enforcement. No support. No support. Its no wonder the army wants new leadership. Sit back and look they are doing the bare minimal until she's gone. Hit the road. Its a shame because she could've made good with the position. The only reason she is getting good convictions is because of good police work. It all starts with the locals and the state. Guys keep up the good work and be patient.

Jim, this is where your double standard bothers me. A comment can't go through about David Ross and his Courtroom attitude, but it can about Dawn Finks. Dan Glassmire has over 100 comments about his latest dumb statement! I don't like that double standard. I think that's where people get upset with this site. We can talk crap on some, bash others and their family, but your chosen few we need to lay off of?

12:38 blogger is obviously a cop who has had problems with the DA. Listen, I want a DA who stands up FOR THE PUBLIC! If the cops are doing something unprofessional, the DA should not be covering up for them! Perssonally, I wouldn't have the Coudy cops doing any undercover stuff!!! They can barely do the basics from what I see!

I see your point Jim, but I've also seen Mr. Ross door to door campaigning with Mr. Wastson. So I see him as a public figure.

I have seen many articles on here were others, (sometimes family members of criminal defendants), get their name harshly evaluated. But, like I said I see your point.

Just disagree when we are voting for a very important position why observations can't be talked about on here. They are any other time.

Nope it was not a police officer that made certain statements that people are referenceing. I have talked to the state boys and many local police recently and this is thier perspective and my observations. Its not a pretty cite. Sorry you can't pin this one on the police.

To 11:02 poster: The truth of the matter is that the VAST majority of cops are very happy with Fink as DA--I have talked to a bunch of them myself! There ARE a couple- one "statie" and I guess one Coudy cop who don't like her, but guess what? When you do your job as a public official, and really DO your job, you're bound to make some enemies. Esp if you're a woman in Pennsyl-tucky! I want a DA who calls it like it is and stands up for what's right-even if it ends up hurting a cop's ego. Fink has guts and that's what we need. I'm writing in DAWN FINK in November!

You work with Dawn for four years like some of us have and you will come to understand the truth. Unprepared, illadvised, unprofessional, not bringing files to court, not reading reports, askling questions a first year law student should know. Watch that happen for four years and then tell me she is so good. (I doubt this will make Solomons cut and get printed, but at least I tried.)

Well, poster at 12:01, I don't know who you are-probably a Watson supporter who has never set foot in court--but I have spoken with folks who have served on juries when Dawn Fink tried different cases AND have spoken with various court personnel, inc. the judge and THEY ALL SAID WITHOUT HESITATION that she does an excellent job as DA. I was even in court one Wednesday when they do cases all day long becasue my brother had his camp broken into. I saw NONE of what you are talking about! Dawn Fink was every bit prepared, courteous and professional and things ran very smoothly. Her staff seemed very nice too. Mrs. Steiner helped my brother with his claim for restitution. So I believe that your nasty comments about Dawn are unwarranted to say the least. I suggest you post your name so we can see if you are even in a position to have an opinion about the DA. My guess is that you are either a man who resents a woman in authority who makes more money than you do, or the comments really came from Andy Watson or his partner, David Ross. Guess we'll never know... By the way, I am surely writing Dawn Fink's name in on the ballot in November as is my brother!
