Shooting Was Justified In Standoff With Police In Potter County

COUDERSPORT - Potter County District Attorney Andy J. Watson has declined to prosecute the state police Special Emergency Response Team member who fatally shot an armed and deranged man March 7.

About 9:45 a.m. that day, dispatchers received an anonymous call from police that Joshua C. Wheeler was walking around in Harrison Valley near his residence on School Street while "drunk, acting crazy and carrying what was believed to be an AK-47 assault rifle." More...

Bull Watson You need to be replaced. Just because it's a cop does not always mean its right. Cops have way to much power in this country. You people in the Court system need to stop siding with cops all the time.

This is absolutely the correct decision by DA Watson. No point in wasting tax payer $$ to prosecute the police in this situation. They did their job.

I guess people up there like the old wild west style form of justice because this may be one of the most justified uses of deadly force I have ever witnessed. If you buy an assault rifle and start shooting it out your windows and the cops show up and you keep shooting YOU ARE GOING TO DIE. Plain and simple, anywhere in this country. You're committing suicide by cop. You are going to get shot. This is the law and what every officer is trained to do. I am shocked everyone is surprised. If the police can't use deadly force against someone who is shooting a gun in their direction then let's just take their guns away and give them batons like in the UK because there is no reason for them to be armed.

Of course if you're a friend or family member of this man, you're going to have a skewed view on how things should have gone down. HE SHOT AT POLICE! He blew 80 some shots out of a window. If it was anyone else that you didn't know personally, you would have said that the police responded properly.

Its sad for the loss of life, BUT......it is a good day when the police are allowed to use the training they have to protect the people they serve. Had this person been left to carry on with this behavior, how many people would have suffered injury or death? Kudos to PSP!!!

That being said the PSP did exactly as they should have in this situation.

It is sad because we come from a small area and the saying goes, "if your are not related to them you know them, and this is so true.

if they were protecking the commuite. then why did they not shut down 49 thru town. 49 for one fourth of main street was in his fireing range. the call came out at 9:45 am we drove by twice. then at 12:00pm we went to town. to get our child who was.at a house in dereact line of the window in which he shot from we all stood there talken for over 1hr and a have be for they ask us to go in side. people was walking home from church.if he was as bad. as every body said he could had. a feild day just from all the cars going by all day. no. they dragged it out. lied to him.said they would get a nogoshater in there to talk to him.and they never did.WHY DIDN'T THEY? DIDN'T WANT TO SPEND THE MONEY TO HELP SOME ONE .. no they brought snippers and made him feel even more trapped. R.I.P JOSHUA WHEELER.

I guess you should be thankful you and your child were not hit with a stray bullet!

Why would you be standing in the area for an hour or more that it was reported that someone was aimlessly shooting a gun???

The DA made the right decision, everyone should just be thankful that Josh did not hit anyone, I am sure he did not want to hurt anyone...
