Federal Judge Stops NYS From Collecting Tax On Seneca Cigarettes

Judge Rules in Favor of Senecas

Temporary Restraining Order in Place

A federal judge has ruled in favor of the Seneca Nation by issuing a temporary restraining order that blocks New York State’s attempts to collect taxes from them for 14 days.

Judge Richard Arcara made his ruling earlier this afternoon.

Yesterday, a state Supreme Court Judge lifted an injunction that kept New York from collecting the taxes, which they said they intended to start collecting tomorrow.

After the judge’s ruling yesterday, the Seneca Tribal Council voted to stop making payments to the state from its casino slots revenues.

The slots revenues add up to about $700 million. The state expects to collect $200 million from the cigarette taxes.

Good for the Seneca Nation. New York is the most tax happy state east of the mississippi. After what we(white people) did to the Indians the least we could do is give them tax relief. For God sakes we already stole their country from them

Kudos to the Judge to grant the Natives their sales without taxation. Some people do have a heart in the legal system. To all the greedy asses I hope it hurts your pockets that they are going to stop giving the Government their slot revenues.

I don't know what you are talking about......I nor any of my relatives have done anything to the indians. My ancestors came to the US in the late 1800's and stayed in Pennsylvania. Don't you people think it is getting old stating things like this? I think we need to deport all of the people that have German ancestors becasue of what the Nazis did.....

Congrats to the judge I am with the Seneca's on this one, after all the injustices done to all Tribal Nations. This is a victory atleast for 14 days and hopefully permanent-greedy government back off.

WHEN is that idiot they call governor in NY gonna realize h e is fighting a losing battle with the Senecas. I say LEAVE THE INDIANS ALONE. They have done nothing to us. Gov. Patterson needs to read the Indian treaties or something...Oh wait I forgot he's blind.....he needs to stay out of the Seneca's business....

OK John Q, I don't know who you are, but it really does not matter as the point is the same regardless of your ignorance...

We, "Americans" and yes that includes you and every other person here who's precedents are of any other ethnic origin than "American Indian", including me, took this country from the Indians. Some of it was stole from them for mere trinkets because the Indians were generous and willing to share their plentiful lands. The rest of it was taken by force and the original land owners, the Indians, were forced to live on government established reservations. These reservations were generally located in the shittiest areas that the government could find, as nobody else wanted to live there. Then when the government realized how ice Florida could be once it was colonized and developed, they took the majority of that back too. WE have been forcing the only indigenous people in North America into smaller and smaller areas. The only thing that these people have left is their land and the tax exemptions that were granted to them by the government that stole their land from them. This was given to them, without limits of time, which makes all of this wrong on so many levels. The government made the rules, and now that they see a $ at the end of the tunnel they want to change the rules yet again to suit their own greedy needs.
If NY doesn't have enough money, let the elected officials give something up, lower their pay, pay their own rent and utilities, buy their own cars and insurance, etc...
LEAVE THE DAMN INDIANS ALONE AND SLITHER BACK UNDER YOUR ROCK!

I keep hearing on the Olean radio staions commercial "tax free" gas. Well if the Natives really sold "tax free" gas, it'd be about a buck a gallon. Now, who's scalping whom?

There are approxiamately 7200 Seneca indians on the reservation. The casino pays NY State 700 million from their casino revenue per year. This means that the casino net in the Billions per every year, yet the majority of the seneca people are below poverty level and survive from payments from the US Government. If the indians are SO concerned aboutthe welfare of the people, then why don't the casino owners share the wealth with the rest of the tribe.....like they always claim is part of their heritage? These people are no longer indians...they are out for money just like every other greedy American...they should be treated the same way.

The Catholic Church is another tax exempt organization that makes millions, maybe even billions of dollars every year. Yest parishes close daily from lack of funding. Does this mean that they should have to start paying taxes because they don't spread their wealth? It is not about how much money they make or how many of them are poverty stricken and living off the government, it has to do with an agreement, without end, that was signed by the US government with the Indians of this fine nation that WE, the power hungry Europeans took from them. Personally I feel that if the government allows NY to renig on this agreement it will help to destabilize the judicial system and undermine the US government authority even more than it already is. NY has their eye on the almighty dollar and they will not give up until that desire is satisfied. I wouldn't blame the Indians if they got hogstyle and totally shut down all throughfares within their reservations nation wide. We have taken enough from these people.
