Judge Orders Anonymous Commenters To Be Identified

Judge orders identities of commenters be revealed
Thursday, August 12, 2010

Anonymous bloggers beware. You may not be as anonymous as you think.

Forward Township Supervisor Thomas DeRosa has won a court victory in the action that he filed in November to uncover the identities of people who posted comments on an online bulletin board that he said defamed him.

On Wednesday, the ACLU, which had intervened in the case, turned over the Internet Protocol addresses of six individuals who made specific posts that Mr. DeRosa mentioned in his court filings.

That action follows an announcement Tuesday night by West Mifflin Area school director Albert Graham, who vowed to take legal action to obtain the names of individuals who he said had posted threats against his life on the West Mifflin page of the discussion board Topix.com.

Web service providers have protection from comments made by third-party posters under a federal 1996 telecommunications law. But some courts require them to release the names of posters' identities if a strong enough case is made for defamation. More...

Anonymous comments are not a "civil liberty," or a form of "freedom of speech!"

If you say it, you better be able to own it!!

That's the problem with "anonymous," people think it's a free pass to attack a person over heresay and rumors.

Mess with the wrong person and bet your rats ass you'll be held accountable!

Do you really think your posts are "Anonymous" anyway? SOMEONE has the capability to find out who is making posts. That's why you never put anything online that you wouldn't want your granny knowing about you! An, yes, I am leaving this as an anonymous post because I did not say anything to incriminate myself! :o)

This is a slippery slope for sure!

Good, People should be held accountable for threatening and slanderous remarks.

This is such a bunch of BS!

"While the IP addresses that were supplied to Mr. DeRosa don't immediately identify the individuals, they do identify their Internet service providers and now Mr. DeRosa and his attorneys can petition those providers to release the names"

So what if I take my laptop accross the street and connect through my neighbors wireless and make incriminating remarks about someone. This type of identiification will be immediately dismised in court because they can't directly ID on person or even a specific computer by it's IP address.

It doesn't matter here, Jimbo censors the comments that fit his agenda. He has no problem posting comments that slander some folks when other views are omitted.

Anonymous said...

Please do not be so critical of Jim for censoring and such. There are times when he may refuse to print a comment because it is out of bounds but some of you dildines deserved to be censored and besides, somebody has to be the referee and he is good enough to do it. Be thankful.
PS: A poem--

Some dildines their words are like venom.
So the moderator he has to prevent 'em.

What in the hell is a dildine ?

Anonymous said...

I wish he would census every comment that has the word "dildine" in it. That word, and the people who use it, are so retarded.

Anonymous said...

Oh I wish the same! I loathe the word dildine. find a new one, everytime certain people post they have to use it in some form.

Earl, welcome back. Your lyrical words have been missed.

I wish I could write poems like Earl.
But when I try it I sound like Ives as in Burl.

Mr Realistic.......Secure your wireless connection then!!!

Anonymous said...

It's not as easy as securing your wireless connection.
I live with 7 roommates. Our connection is secure. So tell me, then how would they ID just one of us responsible?
Mr. Realistic... is being realistic.
