Commonwealth Court Judge Denies Bid By Industry/Legislators To Enter Lawsuit

HARRISBURG -- A Commonwealth Court judge has denied a request by the gas-drilling industry and top Republican legislators to intervene in a lawsuit challenging the constitutionality of the state's new Marcellus Shale law.

Senior Judge Keith B. Quigley wrote in a decision today that the legislators do not have a "legally enforceable interest" in defending the intent behind their law. He wrote that the interests of the industry will be represented by the state as it defends the constitutionality of the law.

The judge turned down requests to participate in the case by Senate President Pro Tem Joe Scarnati and House Speaker Sam Smith, as well as those by a collection of industry trade associations and companies.

Officials from seven municipalities, along with a Monroeville doctor and members of the Delaware Riverkeepers Network, have filed a suit arguing the the law constrains their ability to protect residents by how they craft zoning rules. Of course Scarnati wanted to quash it, he's the epitome of being bought and paid for by big business and outside interests. Can anyone tell me how a low ranking member of the legislature can rise to the pro-tempore position in his second term as senator? Especially one from a rural, small, relatively unimportant part of the state? He's doing what he's told by someone, this guy doesn't have the brains to do it himself. Don't even get me started as to HOW he got elected, even THAT was a goat****. God help us all.

5:53--What a stupid thing to write. How on earth would that remind you of how Obama got elected? Let me refresh you on how Scarnati got elected. The incumbent was Slocum, a Repub. from Warren, who was also the sewage treatment operator in Youngsville, Warren County. Slocum was convicted of opening the gates on the sewer plant during high flow period(s), and to this day is the only person EVER sent to jail for this. Anyhow, the Repubs asked Slocum to not run, as he was a convicted federal felon, but he refused. Scarnati, like the egg sucking dog he is, snuck in the back door and ran as an independent, won the election after the R cronies (mostly CR Johnson) put out the word that they didn't want Slocum. After the election, Scarnati changed back to R, even though he was elected as an I, and has been in the pockets of those who put him there ever since. Yep, good old Joe is a scab, a political carpetbagger who runs and changes AFTER the people speak. Makes me sad and ashamed to be a lifelong Republican, but oh well, I was here before him and will be after him when the powers that be discard him like they did Slocum. Rememeber Joe, like a spouse that has an affair and leaves to be with the lover, THAT relationship will end like it began, usually with another choice. The grass is always greener, right? So anyhow, numbnut at 5:53, it doesn't have anything to do with Obama, and redneck retard aint just a river in dildine county.
