Killing of Dogs or Cats Is First Degree Misdemeanor In Pennsylvania

It has been brought to the attention of the Pennsylvania SPCA that animals may be being shot, and / or poisoned..


The only legal remedy for controlling stray domestic animals is to capture using a humane trap, and surrendering them to a shelter.


Title 18 § 5511. Cruelty to animals


(2.1) (i) A person commits a misdemeanor of the first degree if he willfully and maliciously:
(A) Kills, maims, mutilates, tortures or disfigures any dog or cat, whether belonging to himself or otherwise.


(B) Administers poison to or exposes any poisonous substance with the intent to administer such poison to any dog or cat, whether belonging to himself or otherwise.


(ii) Any person convicted of violating the provisions of this paragraph shall be sentenced to pay a fine of not less than $1,000 or to imprisonment for not more than two years, or both. The court may also order a presentence mental evaluation. A subsequent conviction under this paragraph shall be a felony of the third degree.

what if shelters are full and do not want any more? why not go get people that drop them. Not people that try to put them out of there misery. If people have pets and do not want more get there pets fixed. O wate it cost to dam much.

Yes and I will shoot any feral cat that is on my property. My local SPCA will do nothing with cats. They only take dogs. I've been told by PSP that it is ok to kill cats if they have no owner. Btw the state of Pa doesn't even recognize cats as a pet

9:12 Thank you-I have posed that question many times with no REAL explanation. I have family who worked with Helen for years and are still perplexed and MORTIFIED that her wishes have been ignored. I'm sure she is rolling in her grave!!! The ONE thing Helen ALWAYS talked about was her love for animals. There are people out there who SHOULD be COMPLETELY ASHAMED of themselves.

8:26:00 PM The reason there are no laws regarding cats is because cats are considered wild and not domesticated like a dog.

no shelter around McKean county takes cats. and when they do the charge you to drop them off. they deny that but ask around and you will see.

Should be a felony to begin with.After numerous family members that most call animals have been murdered with absolutely no support nor investigation or prosecution we understand how this all works.Miss Swetland's money is gone,we pay for licensing,we pay for an animal cruelty officer who explains that according to the law a pet is a piece of property no different than a mailbox.When you see rigid enforcement of mailbox smashers and less than nothing being done to pet killers you get a clear picture of the priorities.When you don't care about living creatures you don't care.The cruelty displayed toward animals by ALOT of people in Potter County would keep a real cruelty officer busy 24/7 for a lifetime.The PSPCA told us six months after receiving Miss Swetland's money that they were now going to put more priority on cruelty cases.We thought that was pretty rich when their name is Society for the PREVENTION of CRUELTY to animals.Comedians too.

Does anyone know what the law is in regards to people leaving their dogs run unattended? I hunt in Bingham Township and a local veal farmer lets his dogs run. They chase deer frequently and a neighbor said that they were already bitten once. The dog owner/farmer is already aware of the situation but choses not to do anything about them. What can be done to stop this or get it under control? As far as I am aware there isn't a dog warden that will address this anymore. I hear they just can't keep a dog warden on. They keep leaving.

Who is going to keep the feral cats from killing all the rabbits, birds, young turkeys and other wildlife? I have never seen anyone come pickup a feral cat.

Does anybody care about the killing of unborn children? What a world we live in, we will be fined and go to jail for killing an animal the SPCA will end of killing anyway but it is ok to kill a unborn child
