Charges dismissed in alleged infant-for-cash case

All charges in the alleged infant-for-cash scheme in Potter County have been dismissed on “speedy trial” grounds.

The case has been ongoing since May 2011, when charges were filed against Coudersport attorney Jarett Rand Smith, his former wife Donna Albright-Smith, his brother Jerome Smith and sister-in-law Eileen Rifka Smith, along with the child’s mother, Krista Eveland.

On Dec. 8, an order was filed in Potter County Court by Senior Judge Robert Sacavage dismissing the charges against all parties, saying the prosecution did not “act with due diligence” in bringing the case to trial within a one-year period from when the charges were filed.

The case originated with Coudersport-based state police, who had alleged Jarett Smith and Albright-Smith offered Eveland money in 2009 if she’d allow Jerome and Eileen Smith to adopt her baby, according to court records. Read more...

This is a bunch of BS.Anybody else would be in jail but because he is an lawyer I guess that makes it ok. Where is justice in this country any more?

Let's see if I understand.

The prosecutor(Lawyer) doesn't want to prosecute Smith(Lawyer)
or Mrs. Smith(Lawyer's wife) or
the other Mr. Smith(Lawyer's
brother) or the other Mrs. Smith(Lawyer's sister-in-law) so he drags his feet for 3 years.

The judge(Lawyer) concurs.

And this is legal in Potter County??!!!??

Wow! Good old potter county! Eveland still has custody of the child....I'm so sick to know that our children are not protected! This county just does what it wants. ..some apparently make their own laws! What is our society coming to? Unfortunately if I wasn't COURT ORDERED to live here I would be gone. ..but unfortunately when you have money, the last name and friends in the legal system you can have what you want or have someone court ordered to live here

Two bad things happened:
--This alleged criminal act was never brought to trial, so everyone everywhere has to admit that there will never, ever justice in this case. Not fair to anyone.
--The Attorney General's Office of Pennsylvania performed abysmally, staring with Corbett at the helm and continuing with Kane. It's a lot like the FBI investigation into a certain disgraced music teacher who is behind bars for rest of his "life" for murder but not forgotten and STILL not facing the consequences of the FBI investigation.

This is the same lawyer that was promised a 13,000 van from my now ex if he screwed me out of everything. (He was my lawyer) mistake... the van got crushed he got nothing also so yes karma.

I think this is crap we should change our signs from "welcome to Potter County Gods Country" to "Welcome to the crap country where you can sell your babies and get away with it" Just when you think things cant get worse look what happens. I hope this child gets the best life possible!! But as for the mother WOW she shouldn't be a aloud at all!!
