The state Attorney General’s office is appealing the dismissal of charges against four people charged in an infant-for-cash scheme in Potter County to the state Superior Court.

The dismissal of criminal charges — against attorney Jarett Smith, his brother Jerome Smith, sister-in-law Eileen Smith and mother of the child in question Krista Eveland — was an “outrageous abuse” of judicial discretion that leaves the “notion of bias (hanging) like a thick and low-lying cloud” over the case, reads a scathing appeal brief filed by Senior Deputy Attorney General William Stoycos.  Read more...
