Former DA: Serianni should have served jail time

EMPORIUM — Former substitute teacher Jon Serianni isn’t spending time in jail for his conviction on child pornography charges, and how that sentence came about remained a matter of contention the day after a probationary sentence was imposed.

On Wednesday, former Cameron County district attorney Paul Malizia contacted media outlets that covered the sentencing hearing the day before, taking issue with the characterization of the sentencing by reporters. Read more...

Look like the Former DA is now throwing the Judge under the bus....... The way I see it, someone should be thrown under the bus for this injustice to happen.

I think what the former DA is saying is that when Serrianni plead guilty, there was NO plea deal involved. Instead, it was an OPEN deal to be decided by the judge at the time of sentencing. Both the DA and the defendant's attorney had a chance to speak and state their case as to what the punishment shout be. The defense attorney did indeed speak and plead his case for no jail. HOWEVER, Cameron county current DA. Mrs. Miglicio DID NOT plead for jail time. Actually it is my understanding that she did not speak at all. The judge made his decision and when it was said and done people were upset. Our current DA, Mrs. Miglicio through Paul Malizia under the bus blaming him for making this deal. HE DID NOT MAKE THIS DEAL. Mrs. Miglicio did not, DID NOT do her job!!!

11:26 Your understanding is wrong. I was in the courtroom. DA Miglicio did speak up when the judge said that at a meeting in September Serianni agreed to plead guilty with the understanding the mitigating sentence would not include jail time. DA Malize must have been at the meeting since he was in the DA position. DA Miglicio pointed out she was not at that meeting and is surprised by the sentencing agreed upon. The finger pointing is typical in todays arena and the only person it has hurt in this case is society by sending the message you can purchase porn of underage girls and only have your wrist slapped,

While this guy certainly needed to spend jail time lets not forget that these "children" were exchanging these pictures long before he became involved. Parents need to be involved in their kids business and that included social media. Who the hell lets their kids take provocative pictures of themselves and send it to another kid. It's all fun and games until they fall into the wrong hands. EDUCATE YOUR KIDS!

It looks like Mrs. Miglicio is trying to throw the old DA under the bus because she did not do her job. She is new to the job and has not been a lawyer all that long. I understand she did not even argue for jail time at the hearing? Take some personal responsibility Mrs. Miglicio and just admit you made a mistake. The job entails a little bit more than you thought doesn't it????

Any one who has ever been in Judge Masson's courtroom knows that he is very clear at the beginning of a proceeding with his instructions. If he stated, as noted in the article and confirmed by another comment, that the plea agreement was that there would be no jail time then that was the deal Mr. Malizia made. If it were as Mr. Malizia states then the judge would have asked for the recommendations of the defense attorney and the current DA, which he did not. If as Mr. Malizia stated that he believed there should be jail time then why would he agree to any plea. Just have the trial.

This is absolutely ridiculous..This man should be drug down the street..should the children be punished? Yes, of course. But can we blame the kids? Absolutely not. This was a man who was responsible for many people children. As an adult you for one shouldn't want to see children naked let alone pay for it. Very sick and this man gets to walk away basically. And I'm going to say if he purchased pictures of juveniles he was headed towards way more than that. Either way great job on letting a pedophile walk the streets with my children ya fux

This is a case of good cop and bad cop. They are cops and are in bed together - it is very evident to anyone who has ever lived in that Town.
