Derrick Gleason Found Guilty Of All Counts As A Result Of Double Fatal Crash In Wharton, PA

Between February 13-15, 2017, a Jury Trial was held in the matter of Commonwealth vs. Derrick Gleason, Docket Number 67/2016 in the Court of Common Pleas of Potter County. Gleason was found guilty of all counts, as follows:

• Count 1: Aggravated Assault, a Felony of the First Degree
• Count 2: Aggravated Assault by Vehicle, a Felony of the Third Degree
• Count 3: Homicide by Vehicle, a Felony of the Third Degree
• Count 4: Homicide by Vehicle, a Felony of the Third Degree
• Count 5: Criminal Mischief, a Felony of the Third Degree
• Count 6: Involuntary Manslaughter, a Misdemeanor of the First Degree
• Count 7: Involuntary Manslaughter, a Misdemeanor of the First Degree
• Count 8: Simple Assault, a Misdemeanor of the Second Degree
• Count 9: Recklessly Endangering Another Person, a Misdemeanor of the Second Degree
• Count 10: Careless Driving - Unintentional Death, a Summary Offense
• Count 11: Careless Driving - Unintentional Death, a Summary Offense
• Count 12: Careless Driving, a Summary Offense
• Count 13: Reckless Driving, a Summary Offense
• Count 14: Disregarding Traffic Lane, a Summary Offense
• Count 15: Driving at Safe Speed, a Summary Offense
• Count 16: Failure to Keep Right, a Summary Offense
• Count 17: Limitations on Driving on Left Side of the Road, a Summary Offense
• Count 18: Passing Left Unsafe, a Summary Offense.

The conviction is the result of Gleason’s conduct on September 18, 2015 at approximately 7:22 PM in Wharton Township. Gleason was operating a 2003 black Kia Spectra. Two passengers in the vehicle were Jessica McKay and Colleen Ackley-Churchill. Gleason was traveling between 85 and 90 mph traveling north on State Route 872. Gleason entered a right hand curve in a no passing zone, traveling on the left side or north in the southbound lane, while trying to overtake another vehicle. At this time a 2015 Jeep Wrangler was traveling south in the southbound lane on 872. Due to Gleason’s multiple traffic violations, he struck the Jeep head on. As a result, both female passengers were killed and the driver of the Jeep suffered serious bodily injury. 

Trooper Stephanie Makin conducted the initial investigation filed charges against Gleason, referenced above. Commonwealth expert Corporal Sean Batterson, performed an accident reconstruction of the accident scene and determined that Gleason recklessly violated multiple provisions of the Motor Vehicle Code, which were a direct cause of death and serious bodily injury to the victims. 

District Attorney Andy Watson prosecuted the case which lasted two and a half days. The Jury was in deliberation for approximately 3 hours and returned with a guilty verdict as to Counts 1- 9. The Honorable John B. Leete presided over the trial and found Gleason guilty of the summary offenses listed in Counts 10 – 18. 

District Attorney Watson extends his sincere thanks for the hard work and thorough investigation by Trooper Making, Corporal Batterson, and Corporal Steven Schmit, as well as the other witnesses who testified during the trial. The Commonwealth extends its deepest sympathies to the victims’ families.

A sentencing date is to be set by the Court. Gleason is currently in State Prison on parole violations.

They have been hiding the evidence on what was determined from a test of the defendant's blood with regard to alcohol or other drugs. Why is that a secret? It is important for that to be made public like it is for people who merely get pulled over for driving erratically.

@1:41 who are "they" and what do you believe they are hiding? Trials like this ARE open to the public. Maybe you should have gone. From what I hear, you would have learned WAY MORE than you would ever possibly want to know about this tragedy. If you're going to flap your gums, at least get your facts straight.

Blood draws have to be subpoenaed. Usually, if they get enough evidence to convict, they won't use up more time to subpoena that piece of evidence. Also, blood draws aren't admissible as evidence unless a search warrant was issued to have it drawn in the first place.

That's is NOT true! If you cause harm to another person like this or anyway and there is reasonable cause to believe they are on drugs, they do NOT have to have a warrant for a blood sample. If they believe your using drugs and you refuse a drug test than that's pretty much saying YOUR GUILTY! Learn your shit.

There was no issues with alcohol or drug use, hence it was not brought up in the trial by either side. Gleason was in a hurry to get to a meeting with his probation officer who had called him about an hour earlier looking for him. It was a tragedy waiting to happen. Sadly, it was preventable.

No it's not true. Actually the fact of the matter is he is charged with vehicular homicide because of drugs in.his systems as well as all the other charges. Someone will not be charged with that unless they have drugs or alCohol in their systems. That's the United States law. Check it out.

Sorry for your lost as well I know it hurts especially this bullcrap. But we know the truth he should've gotten more than what he got. God is the leader. We as fAmily know the truth when the State Troopers had called the family's to let them know that our loved ones was dead because some freaking idiot. He will sit in prison until he EOS the probation violations sentenced he is on then he will start serving the time they hand over to him.who knows each count he may be ran consecutive. That would be awesome.

You should probably study the law a little more hunny. He was charged with those charges because he was SPEEDING, not because of drugs. He did not do drugs and was completely clean. Sorry for your loss and understandably your grieving but you shouldn't state things that aren't fact.

Sorry but a DUI would have made his charges even worse. The reason the tox report wasn't brought up in court by the DA is because it wouldn't help his case. .it was completely clean and only common sense tells you that's why. Believe whatever makes you feel better but you should post that is what you believe, it's only your opinion..not a fact.

It doesn't matter what he had in his system, the fact of the matter is that this mans stupidity took away the lives of two women. Jessica is my little sister and i will never have the chance to talk to her or ever see her again. Both of them were mothers, daughters, sisters and aunts. they will not be able to see there babies grow and get married and have babies of their own. No time he serves will ever be enough to bring them back to us. I'm not gonna stress over what he gets because personally I believe in an eye for an eye, but they don't have the death penalty in the state of Pennsylvania. I know in my heart that the jury will make the right decision when he is sentenced. Every decision he made that day will haunt him for the rest of his life and if I had my way Jessie and Colleen would too. It doesn't matter if he was drinking or hell even driving with his damn eyes closed. He was going almost 90 mph on a curve passing someone, he might as well of been driving with his eyes closed while intoxicated. I haven't always had faith in the judicial system but my gut tells me he will get what he deserves during sentencing. To Colleen's family and friends: she will always be with you in your heart just like I know Jessie will be with us....They are both dancing with the angels <3

You know...it is so very easy for you all to sit and judge based on partial information, but what the ignorant NEVER know, see or even CARE to see is that there are reasons (NOT GODLY) for EVERYTHING. A person becomes the way they are for a REASON, and that includes judgmental assholes like so many above. For those who sit in judgment and call themselves Christian while referring to "God", apparently you need to return to Sunday school, or, hey, read the bible you quote when it fits YOUR opinions. As one mentioned, there is a LOT more to this case, there were NO drugs involved (like many of you keep spouting off about with general stupidity). What is the quote? "We the ignorant, led by the unknowing?" Oh, wait...that is above MOST of your education levels. There were several victims in this case, including the defendant. What did he do? Speed. Like MOST of you have not done that in your lifetimes? Before you spout off about your speeding not killing anyone remember, it is VERY possible. Just as it is VERY possible that you could get distracted and have the same outcome from such and if that happens to you, and you are one who has judged here without knowing the facts, enjoy YOUR outcome and the judgment from these very same people who hide their embarrassing ignorance behind "Anonymous". Why am I Anonymous? Generally, I choose not to be, but since so many of you choose to hurt others behind that pseudonym, I thought I'd inflict the same in the same manner.
